There are definitely issues with the app store.
1. There is no demo software available. So developers either have to make a watered down version for free or hope people will take the risk on some unknown developers software.
2. No SSH or encryption software on developer software preventing SSH client or other protocols to be used.
3. Unexplained disappearing apps. Can't find iPint anymore and Netshare disappeared without any official word.

Have Apple contractually agreed to a period of time? If so, you could still have legal claims act, is'n it?

The debate about the iPhone App Store, now the iOS App Store, is over. I don't really understand your question, but in terms of time, Apple is not bound legally to any time limit as far as I am aware.
