Ridiculous money grab. And that's it. I can't believe somebodies time is wasted by this kind of lame crap. Maybe I'm alone in my opinion, but honestly, suing Apple because you're not satisfied with your 3G service? I'm sure AT&T lets you cancel your contract within 14 or 30 days. And hairline cracks? Get a life. A product becomes used the moment you open it.

Completely agree. Not only do I think these cases should be dropped but I also feel that the plaintiff should be forced to pay all costs caused to the defendant. Hopefully after a few cases and several thousand dollars these people will begin to understand how stupid and wasteful they are to the rest of society.

You're not the only one that's tired of these stupid lawsuits. This country has gotten to "Legal Happy".
To start with, suing Apple over AT&T's issue? Like Apple has anything to do with that! If AT&T is claiming they have the largest and fastest 3G network they better deliver. With as many iPhones as they're getting revenue for, they best get on their game.
As far as the alleged "crack". I know three others personally that got one and, uh, no cracks. She probably dropped the dang thing on the plastic back without a case protector.

actually the hairline cracks are a huge issue, just go over to apple's boards and search for hairline cracks. there used to be a thread with hundreds and hundreds of posts about the cracks (with people posting photos) but apple seems to have removed it. most people don't have the problem but that doesn't mean there are tons out there with phones having this problem. the hairline cracks are real, i've seen them and it's one of the reasons why i'm sticking with my 1st gen iphone.

After reading this preposterous story of false advertising. I understand the slowing of the networks, but why sue apple, when you should sue AT&T for the direct problem instead for false advertising, people do that all the time, just usually somebody doesn't have the stupidity to act on it. And for the hairline cracks?!?!? Come on, get a grip, so what, its not like it is harming you in any way, its nothing, and its not like you are going to intentionally drop your iPhone in water and say: "I wouldn't have broke if there wasn't hairline cracks!" People need to focus more on the issues that people give a crap about, not the stupid ones that make no sense!

I haven't had any 3G network issues but I don't use data on my phone and that doesn't mean it isn't a problem that doesn't exist. Though, read what I have to say later on. Most are correct, this is likely an AT&T complaint as such a symptom would likely be caused by too many users trying to access that specific cellular tower. Though, that would mean this problem is isolated to much, much more populated areas.

Cracks. OK...They exist. We have a few concerns to make sense of before we get "uppity."

? Are these absolutely not user inflicted? Are they truly a design flaw?
? How many units are affected by this? Chance is that if it is a real problem, Apple knows about it but it is such a severely small percent that they deal with it yet on a case by case scenario. A bummer but makes a ton of business sense. I've seen claims of 6.9 - 7.0 million iPhone 3Gs sold and one site claims that by looking and compiling IMEI data, 10 million have been at least produced but many of those are probably just store inventory right now. So, let's say 1% have this problem. 70,000 units. 1% isn't shit to any company, at least no where near considered a major problem to have any kind of absolute refund / replace plan in effect. However, does anyone think 70,000 iPhone 3Gs exhibit this? I'm leaning towards not but maybe that's just me.
? What's a class action lawsuit going to do, get everyone involved a new iPhone 3G? HAH! Not likely. It will give the attorneys more than enough to purchase 5 for each member of their family but each plaintiff may get a $20 credit to the Apple Store or something. Sheesh. Give the lawyers more reason to continue to be vultures. Good going.

I really don't get money-grubbing people like Avi Koschitzki (the name says it all really), why doesn't he just buy an Otterbox for his iPhone and be done with it?
So 10 poor people will be pulled out of their places of work to be on the jury for this waste of time!? The only people that will win with this ridiculous suit are the lawyers. Avi needs to get a life... or a Blackberry Storm if he's that annoyed at Apple and AT&T.

I've had 4 iPhones brand new out of box with hairline cracks in them.
Just got the 3gs today and it has them.
This is iPhone #5 in the past month I've had to swap.
Going for #6 and will continue until everything is right.
