I reported the problem to the Apple store - online - and got an email back telling me to contact the developer.
I called the Apple 800 number but always get an automated hang up result.
I have tried all the recommended diagnostic steps like deleting and reinstalling, etc. but no success.
There does not seem to be any way out of this box. How can anyone buy apps if there is no assurnace of getting something for you money.
Does anyone know what can be done?

Depending on what you mean by "does not work" there's a good chance you can get a refund following the process described here:

Ok thanks, I will give it a try, Does not work means that the startup screen appears there is a second pause and then the app shuts down.

Ah. That's a crashing bug. In theory the crash logs are going back to Apple (unless you told it not to when you set up your device) and being made available to the developer, but it's up to the developer to look for them, read them and decide to commit the resources to doing something about the cause.
If you did disable the transmission of diagnostic information, you should still be able to send the developer a crash report manually (if you have contact information for them) after a sync. They should be found in ~/Library/Logs/CrashReporter/MobileDevice/[DEVICE_NAME].
What app is it (he asked, hoping it not one of his)?

Just for your curiousity, the App is Battleship Armada HD by Appster. I will check out the diagonistic info feedback since I don't know off hand what the setting is.

Oh. Wow. Good luck getting some kind of satisfaction. From a quick skim of their catalog it looks like that run pretty close to the edge of being outright scammers.

you may be having an Apple ID authorization problem
Restart the app you are having issues with
