You know, that may not be clear at all... it's quite possible that Apple won't take any direct action until Psystar actually manages to successfully
sell something. After all, I can claim all day long that I'm selling exact copies of Company X's patented high performance Widgets -- only mine are called Gadgets -- but if I'm lying (or simply incapable of delivering said Gadgets for some reason), then the people who are going to be the most interested in bringing suit against me are the ones who actually gave me money for a Gadget!
In that vein, I wouldn't be surprised if Apple's legal department was amongst the first few orders Psystar received. Once they've received their shiny new Open (Mac) Computer, Apple will have irrefutable proof that Psystar is making good on their claims; rest assured that Apple will be doing a lot more then simply making phone calls at that point.
Also, the "bad press" that Apple receives is entirely insignificant until Psystar demonstrates that they are able to continue selling their Open Computers, and still remain viable as a profitable business venture. Us "geeks" are all buzzing about this like crazy... but there has barely been any mention of this at all in the non-geek news outlets. (Do your own Google search on Psystar, if you doubt me; I got to about page seven before I gave up.) And since "geeks" by their very nature tend to be a minority of the overall populace, this entire thing is still in the noise for now.
And lets face it... one way or another, Psystar is a flash in the pan which will probably be all but forgotten by this time next year -- except for as a bittersweet memory to pundits who are still blustering that Apple's prices are too high. (Which they arguably are... but then, so are Dell's prices and HP's prices and Lenovo's prices and.........)
