To be clear: Mute is when you talk but don't want someone to hear you talking.

You're not talking about your iPhone not ringing are you?

But when you make a phone call there IS a mute button right there on the left upper side.
What are you talking about?

SORRY FOR THE CONFUSION. thus is what happening:

when I make ro received a call, for some reaso my MUTE BOTTOM comes on. I`m not sure why my screen is on time to time, ot allways I dont think I move my phone away from my face to much so the sensor will bring the screen on. so I hope this will help, and I`m soory for not being clear on my question.

Okay .. So we're totally confused now.
There is no sensor for the mute button - to activate the mute you press on the screen.
If you pull away from the phone it does not automatically go to the mute condition.

tom, i'm not sure if you're intentionally confusing the situation but i think it makes perfect sense. correct me if i'm wrong, but the complaint is that somehow during a call the MUTE function is being activated unintentionally. there is a sensor to turn the screen off when it's against your ear to avoid accidentally pushing buttons (like MUTE) while talking. Sounds like maybe this sensor isn't working correctly and your face is accidentally pushing MUTE.

I've never had this problem personally. Have you tried asking someone on a call to hold a second to give you a chance to pull the phone from your ear and try placing your finger over the sensor (right above the ear speaker hole) to see if it's at least doing most of it's job? Otherwise, if you can duplicate this in an apple store they might give you a new (refurbished) phone to try instead.

Sorry I don't have an answer for you, I just figured I would try to make this post a little clearer because for some reason it seems the obvious is getting missed.

I just tried it on my iPhone and when i pull away from the phone it doesn't automatically go into a muted condition.
I've never heard that there is a sensor just for this kind of thing. I think the confusion is that the poster doesn't
know what the phone's supposed to do.

no, the phone is not supposed to go into mute. that is the point. his phone is not preventing his face from activating mute while having a conversation, which means the proximity sensor is not doing it's job.
