The vast majority of users are seeing better than what Apple says they can get.
Wired.com is doing an impromptu study. Go there. The output is showing up here. You will probably have to zoom in at least once to see the data.
For the most part, Apple's advertisement is right on. Many people have less than stellar 3G speeds, but their Edge speeds in the same tests are generally much worse too. People have expectations that are completely unrealistic sometimes.
I have had many of the reported issues, but 3G speeds aren't one of them...

Apple is using a variable value as a selling point. Comcast and ATT any other service provider do the exact same thing and there's nobody suing them for their claims...
The fact is that the 3G network is more than three times as fast as the EDGE network. So, the claim is well within reason. twice as fast is less than three times as fast, so no problem.
They're not making any unreasonable claims.

I sure hope this suit is something "we can get involved in," Mr. nmpike. I can then hopefully look up the individual addresses of all you sue-happy bastards and hassle you until dooms day. Never fails that a group of lunatic Americans have to ruin everyone's day by lodging a suit or trying to get involved in an existing class action suit. Used to be that "murder" in the news made me sick to my stomach because it dominated the news. Now murder has been replaced with something worse: American legal nincompoops.
We need an outright ban on legal action of all kinds. So-called "Freedom" be damned. You people need to learn how to turn the other cheek and bite your tongue sometimes. Life isn't perfect. You think it is because easy because American sadly gives you the liberty to sue to your heart's content and get some easy cash that way. But such is hardly different from you going out and breaking into another person's home and stealing all they have. Lawyers and plaintiffs are thieves, plain and simple. And even when someone has truly been wrong and deserve compensation, I still refuse to accept legal avenues as the best course of action. Again, bite your tongue and move on.
If you've not guessed it already, I hate legal action and have no respect whatsoever for people who seek to get involved in it!

I hate this Bullsh*t. People file lawsuits for the most ridiculous reasons. While I have had a few problems with the 3G on my iphone, When it does work, it works more than "twice as fast". I live in the New york city area and the 3G coverage is great here.
The woman mentioned lives in Alabama. I'm almost positive she should be used to spotty cell phone coverage. The fact of the matter is, even if one person gets 2X the speed of the original iPhone, then it isn't false advertising because its proven to be possible. It's not apples fault you live in the woods.

If you didn't like the speed and/or coverage, then why didn't people take advantage of the return policy? I believe it is at least 14 days, and possibly as long as 30. Nobody said you had to keep the dang thing! If you really wanted to hit Apple where it hurts, return the iPhone, it's not that hard.

One other take on the "2x faster" is that it's an average. Apple's legal team could probably prove that, in 3G coverage areas, the average speed is at least twice as fast. They may use a combination of average and ideal conditions to defend their position.
Without comprehensive statistical data, the plaintiffs will have a hard time proving their case, which is probably why they're trying for class-action. Well...that and the fact that the lawyers will make more money vs. a single plaintiff lawsuit.

All advertising has shades of truth. It is our job as consumers to PAY ATTENTION and THINK.
I am getting an iPhone (1st Gen) tonight. Why? Because I looked at the AT&T map of where I live and saw NO 3G coverage. Sure, where I work there is 3G, but I am sitting in front of a computer. I spent a few hours researching and came to the conclusion that 3G did not work for me and where I live. I used my brain. I guess I paid attention during the Lemmings discussion in Elementary School
Carmax advertises "thousands of cars under $12k" but most of them have 70k miles or more or are not highly rated cars.
Toyota advertises "Corolla's from $15,995". Yes they sell them. You have the option of White, Tan or Silver, Crank windows, manual door locks and little sound insulation. Plus each dealer gets one or 2 a month.
Stores advertise they will beat any competitors price or give 110% of the difference back. yet all of the items they sell have unique product numbers that only their chain can sell so no competitor could possible sell you the "same" thing.
BUYER BEWARE!!!!!! A FOOL AND HIS/HER MONEY ARE SOON PARTED.
Dropping calls, not handing off to slower networks seemlessly, those are legitimate gripes with AT&T and Apple (if you can prove it is hardware related).
