Would someone please explain how a service like this ever was ever allowed to exist without regulation in the first place? How could the FCC allow deception as a core business model to exist in a post 911 era?

Everything is legal, until a law says it isn't.
What really annoys me is the weasel words attorneys jump on.
Apple got slapped in the UK for saying the iPhone 3G was "really fast".
Nobody defined what "really fast" meant, just that Apple couldn't say it.
Compared to my 110 baud modem, it IS "really fast".
