Able to legally sell Panther/iLife 04?

Hi All,
I have getting a new 12" PB that comes with Panther and iLife 04. Am I able to legally sell the full retail copies of these two pieces that I have bought for a defective 12" that I am sending back to Apple (both copies have been opened)? I have all the boxing and paperwork that came with both pieces of software.

If they're full retail and not the bundled software, yes.

The question is: Can you legally buy OS X and iLife from anyone but Apple and authorized resellers? I believe it's in the EULA, haven't checked though. I know this applies to updates at least.

That's a good question. I will try and decifer the licensing agreement, alhtough, if anybody else has any opinions on the matter, please step in.
