Gibson, Activision in legal tussle over Guitar Hero

It's far too difficult for me. I'm hanging on for the eagerly awaited sequel: Triangle Hero...
From a legal point of view (not that I'm in any way legally qualified, bar the occasional speeding ticket) doesn't it weaken Gibson's standpoint if they've already collaborated / licensed other things to Activision to make this series happen (eg. the guitar designs etc.)?
It sounds more like one dept within Gibson not knowing what the other dept is up to / agreeing. Or as Jeffco8 said: lawyers doing what comes naturally to them.

Gibson is not a great company. Sure than can make guitars, but whenever they step outside that world they poison whatever they touch. First they destroyed Opcode, any one remember Vision?? And Gmics,did anyone really think Gibson had the leadership create THE digital standard of music interfaces (Any what kind of self-respecting guitarist was going to plug a cat 5 cable into his/her guitar). Next thing you know Gibson will countersue - - - in the District Court of Marshall, Texas.
